New York State lawmakers are preparing for the state to become a safe-haven for abortion in a post-Roe America, passing legislation that strengthens reproductive healthcare access and legal protections. The legislation anticipates attacks by anti-abortion states on abortion-providers and patients, forbiding New York State from cooperating with out-of-state legal cases involving abortion except in limited circumstances, and prohibiting New York from extraditing a defendant to another state to face abortion-related charges.

Senate Majority Leader Andrea Stewart-Cousins said

“New York remains a beacon for women’s right to choose and that no person seeking reproductive health care in this state or nation is left in the shadows.” 

The package of legislation is a continuation of the Democratic Majority’s efforts to expand reproductive rights for New Yorkers since 2019, building on the Reproductive Health Act (RHA) and the Comprehensive Contraception Coverage Act (CCCA). The legislation includes measures that will protect patients’ identities and their ability to recieve care in New York without facing legal repercussions from states where abortion is illegal, and the legal rights of New York abortion care providers. The package will also benefit New Yorkers seeking gender-affirming care in the state.

This legislation, while one step towards strengthening protections for patients seeking abortion care, is only the first of many. Senator Cordell Cleare, bill sponsor and Chair of the Senate Committee on Women’s Issues, said,

“As Chair of the Women’s Issues Committee—I am very proud that today, our Conference takes a number of proactive steps to ensure that we protect the fundamental human rights of health, safety and choice as it relates to reproductive health care. This is only a first step and there is so much more to be done to ensure that New York is a safe haven for equity, justice and equal rights and outcomes.”
